Climate Litigation and Environmental Disputes: Challenges and Developments

Alerion Avocats had the privilege of organizing a session for discussion as part of the LIX MILS trip with students from the Masters’ programs in International Legal Studies and International Dispute Resolution at IE University.

This meeting provided an invaluable opportunity to explore the issue of climate litigation, an increasingly significant aspect of international law, by shedding light on the legal challenges and recent developments in this domain.

In addition to the environmental law courses offered at IE, this session enabled students to deepen their understanding by confronting theoretical concepts with the analysis of real-world cases, while also examining recent developments in the relevant legal framework.

During this session, Jacques Bouyssou and Luana Nilsen presented key trends in climate litigation through the study of landmark cases such as KlimaSeniorinnen v. Switzerland and Juliana v. United States. They also provided an in-depth analysis of the European directive on corporate due diligence (hashtag#CSDDD) and its legal implications for businesses, particularly with regard to environmental responsibility.

This session also served as an opportunity to introduce the Climate Litigation Observatory, an initiative launched in 2023 by Jacques Bouyssou, which aims to analyse and track the evolution of climate-related cases on a global scale, and to enhance understanding of the legal dynamics in the field of climate justice.

We are delighted to have had the opportunity to share these insights with the future leaders in international law and to contribute to the advancement of discussions on contemporary environmental challenges.
